1. Acceptance of Terms

Welcome to Kiddico, a mobile application provided by New Life Family Health Services ("we," "us," or "our"). By downloading, installing, or using the Kiddico iOS application (the "App"), you agree to be bound by these Terms of Service (the "Terms").

If you do not agree to these Terms, do not use the App. Your continued use of the App constitutes acceptance of these Terms and any future modifications.

Age Requirement: You must be at least 18 years old to use this App. By using Kiddico, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into this agreement.

2. Description of Service

Kiddico is a child health tracking application designed to help parents and guardians monitor their children's health. The App provides tools to:

  • Create and manage child health profiles
  • Track symptoms, medications, temperature, meals, fluid intake, and sleep patterns
  • Record medical appointments and notes
  • Track growth, hydration, and wellness
  • Set medication reminders
  • Generate health reports and summaries
  • Optionally sync data across devices using iCloud (Premium feature)
  • Share health records with another trusted adult via Family Sharing (Premium feature)
  • Export health data in JSON or PDF formats (Premium feature)

The App is available in two tiers: a free version with basic features and a Premium subscription with advanced features.

3. Medical Disclaimer

KIDDICO IS NOT A MEDICAL DEVICE. IT DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. KIDDICO IS A RECORD-KEEPING TOOL TO HELP YOU STAY ORGANIZED. ALWAYS CONSULT YOUR PEDIATRICIAN FOR MEDICAL CONCERNS.

You acknowledge and agree that:

  • The App does not provide medical advice, diagnosis, treatment recommendations, or emergency services
  • Information entered into the App and any generated reports are for personal record-keeping purposes only and do not constitute medical guidance
  • You should always seek the advice of a qualified healthcare provider — particularly your child's pediatrician — for any medical questions or concerns
  • Never disregard professional medical advice or delay seeking it because of information in the App
  • In case of a medical emergency, immediately call 911 (or your local emergency number) or go to the nearest emergency room
  • Medication reminders are convenience features only and do not replace proper medication management under healthcare provider supervision
  • The App does not validate, verify, or interpret any health data you enter

4. User Accounts and Responsibilities

Account Creation: Creating a Kiddico account is required to use Family Sharing. When you sign in with Sign in with Apple or via magic link email, a Supabase account is created to support account management, family sharing, and server-side sync. Premium features tied to device-only use (iCloud sync) are linked to your Apple ID through App Store subscriptions and do not require a Kiddico account.

Your Responsibilities:

  • Accurate Information: You are responsible for the accuracy and completeness of all health information you enter into the App
  • Device Security: You are responsible for maintaining the security of your device and preventing unauthorized access to the App
  • Parental Authority: By entering information about a child, you represent that you are the parent or legal guardian of that child and have the authority to track and manage their health information
  • Lawful Use: You agree to use the App only for lawful purposes and in accordance with these Terms
  • Backup: While the App offers optional iCloud sync and data export, you are ultimately responsible for maintaining backups of important health data

Family Sharing Responsibilities:

If you enable Family Sharing, you accept additional responsibilities:

  • You may only invite adults (18+) whom you trust and who have consented to receiving access to your family's health records
  • You are responsible for managing access — if a relationship changes, you must promptly remove that person's access through Settings
  • Family members you invite can view all children's health records in the shared family. Grant access only to people you trust with this sensitive information
  • You remain the account owner. You can revoke any family member's access at any time

5. Subscriptions and Payments

Kiddico offers both free and Premium subscription tiers. Premium subscriptions provide access to advanced features including iCloud sync, Family Sharing, advanced analytics, and PDF export.

Subscription Options:

  • Free Tier: Core health tracking features at no cost
  • Monthly Premium: $4.99/month, billed monthly, with a 3-day free trial
  • Annual Premium: $24.99/year, billed annually (equivalent to $2.08/month), with a 7-day free trial
  • Lifetime Premium: $49.99 one-time payment for lifetime access — no subscription required

Billing and Payments:

  • App Store Billing: All payments are processed through Apple's App Store via StoreKit using your Apple ID payment method. We do not collect or store your payment information
  • RevenueCat: We use RevenueCat to manage subscription entitlements. RevenueCat receives an anonymized user ID and subscription status — not your payment details, health data, or personal information
  • Auto-Renewal: Monthly and annual subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
  • Pricing: Subscription prices are in US Dollars and may vary by region. Prices are subject to change with 30 days' notice
  • Taxes: Prices do not include applicable taxes, which will be added where required by law

Cancellation and Refunds:

  • Cancel Anytime: Cancel your subscription at any time through iOS Settings → Apple ID → Subscriptions. Cancellation takes effect at the end of the current billing period
  • Refund Policy: Refund requests are handled by Apple according to their App Store refund policy. Kiddico does not issue refunds directly
  • No Partial Refunds: If you cancel a subscription, you will retain Premium access until the end of the current billing period, but no partial refunds will be provided for unused time
  • Lifetime Purchase: Lifetime Premium purchases are generally non-refundable except as required by law or Apple's refund policy

Free Trials:

Monthly Premium includes a 3-day free trial. Annual Premium includes a 7-day free trial. To avoid being charged, cancel before the trial ends through iOS Settings → Apple ID → Subscriptions. If you do not cancel before the trial expires, you will be automatically charged at the applicable subscription rate.

6. Data Ownership and Privacy

You Own Your Data: All health information you enter into Kiddico belongs to you. We do not claim ownership of your health data.

Your Data Rights:

  • Access: You can view all your data at any time through the App
  • Export: Export your data as JSON or PDF via Settings at any time
  • Delete: Delete any or all of your data at any time through Settings. Account deletion initiates a 14-day grace period, after which all data on device and on our servers is permanently and irreversibly deleted
  • Control: You decide whether to enable optional features like iCloud sync or Family Sharing

7. Intellectual Property

Our Rights: The Kiddico App, including its design, features, functionality, text, graphics, logos, and software, is owned by New Life Family Health Services and is protected by United States and international copyright, trademark, and other intellectual property laws.

License to Use:

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download, install, and use the App on iOS devices you own or control
  • Access and use the App's features for personal, non-commercial purposes

Restrictions:

You agree not to:

  • Copy, modify, distribute, sell, or lease any part of the App
  • Reverse engineer, decompile, or attempt to extract the source code of the App
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices
  • Use the App for any commercial purpose or on behalf of any third party
  • Use automated scripts, bots, scrapers, or other automated means to access, collect, or interact with the App or its data
  • Use the App in any way that violates applicable laws or regulations

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

NEW LIFE FAMILY HEALTH SERVICES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, use, goodwill, or other intangible losses
  • Medical expenses, treatment costs, or health-related damages
  • Damages resulting from unauthorized access to or alteration of your data
  • Damages resulting from the accuracy, completeness, or reliability of health information entered into the App
  • Damages resulting from your reliance on the App for medical decisions
  • Damages resulting from data loss due to device failure, software bugs, or sync issues

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Disclaimer of Warranties: THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless New Life Family Health Services and its officers, directors, employees, contractors, and affiliates from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use or misuse of the App
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any health information you enter into the App or medical decisions you make based on that information
  • Your failure to seek appropriate medical care or follow healthcare provider instructions
  • Your misuse of Family Sharing, including granting access to unauthorized persons

10. Termination

Your Right to Terminate: You may stop using the App at any time by deleting it from your device. If you have a Kiddico account, you may delete it through Settings → Delete Account. Account deletion initiates a 14-day grace period, after which all server-side data is permanently and irreversibly deleted. You may cancel your Premium subscription at any time through iOS Settings → Apple ID → Subscriptions.

Our Right to Terminate: We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including if we believe you have violated these Terms, misused Family Sharing, or engaged in unauthorized commercial use or automated scraping.

Effect of Termination: Upon termination, your license to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

11. Modifications to the App and Terms

App Updates: We may modify, update, or discontinue the App or any features at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the App.

Changes to Terms: We reserve the right to modify these Terms at any time. We will notify you of material changes through:

  • An in-app notification
  • An updated "Last Updated" date at the top of these Terms
  • A notice on our website at https://kiddico.app/terms

Your continued use of the App after changes to these Terms constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the App.

12. Governing Law and Dispute Resolution

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which New Life Family Health Services is organized, without regard to its conflict of law principles.

Arbitration Agreement: Any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the United States, and judgment on the arbitration award may be entered in any court having jurisdiction.

Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between you and us individually. To the full extent permitted by law, (1) no arbitration or proceeding shall be joined with any other; (2) there is no right or authority for any dispute to be arbitrated or resolved on a class-action basis or to utilize class action procedures; and (3) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

Exceptions: Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.

13. Apple-Specific Terms

Because Kiddico is distributed through the Apple App Store, the following terms apply:

  • These Terms are between you and New Life Family Health Services, not Apple. Apple is not responsible for the App or its content
  • Apple has no obligation to provide maintenance or support services for the App
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation regarding the App
  • Apple is not responsible for addressing any claims you or a third party may have relating to the App
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary

14. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and New Life Family Health Services regarding the App and supersede all prior agreements and understandings.

Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Waiver: No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.

Assignment: You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riot, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

BY DOWNLOADING, INSTALLING, OR USING THE KIDDICO APP, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. YOU FURTHER ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND OUR PRIVACY POLICY AND MEDICAL DISCLAIMER.
